gpera Terms & Conditions – Legal Agreement for Platform Use

1. Introduction

Welcome to gpera. These Terms and Conditions (the "Terms," "Agreement," or "T&C") constitute a legally binding agreement between you (the "User," "Player," or "you") and the gpera platform operated under Philippine Amusement and Gaming Corporation (PAGCOR) oversight (collectively, "gpera," "we," "us," or "our").

The gpera platform, accessible at https://gpera.cam and through any associated mobile interfaces, provides online gaming services including but not limited to casino games (slots, table games, live dealer games), sports betting, bingo, and other wagering products (collectively, the "Services"). By accessing, registering for, or using the Services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

These Terms govern all aspects of your relationship with gpera, including account creation, deposits and withdrawals, gameplay, bonus terms, responsible gaming obligations, dispute resolution, and termination procedures. If you do not agree with any provision of these Terms, you must immediately cease all use of the gpera platform and Services.

2. Acceptance of Terms

By creating a gpera account, making a deposit, placing a bet, or otherwise using any Service offered by gpera, you expressly agree to be bound by these Terms and Conditions, our Privacy Policy, and any additional rules or policies applicable to specific games or promotions (collectively, the "Site Policies").

3. Eligibility Requirements

3.1 Age and Legal Status

To use gpera, you must be at least twenty-one (21) years of age. Online gambling is restricted to adults aged 21 and above under Philippine law. By registering, you represent and warrant that you meet this age requirement. gpera reserves the right to request proof of age at any time, and failure to provide satisfactory documentation may result in account suspension or closure and forfeiture of funds.

3.2 Jurisdiction and Legal Capacity

You must be legally permitted to participate in online gambling activities in your jurisdiction of residence. If online gambling is prohibited or restricted in your location, you are not permitted to use gpera. You are solely responsible for ensuring compliance with local laws. gpera does not provide legal advice and makes no representations regarding the legality of online gambling in any specific jurisdiction outside the Philippines.

You must have the legal capacity to enter into binding contracts under Philippine law. Individuals who are legally incapacitated, under guardianship, or otherwise restricted from entering contracts may not use the Services.

3.3 Prohibited Persons

The following persons are prohibited from using gpera:

• Individuals under the age of 21.
• Individuals who reside in jurisdictions where online gambling is illegal.
• Individuals who have previously been excluded or banned from gpera or any affiliated gaming platform.
• Individuals who have self-excluded from gambling activities through PAGCOR or other responsible gaming programs.
• Employees of gpera, its affiliates, game providers, and their immediate family members.

Accounts created by prohibited persons will be closed, and any funds may be forfeited in accordance with applicable law and PAGCOR regulations.

4. Account Registration and Security

4.1 Account Creation

To access most features of gpera, you must create an account. During registration, you must provide accurate, current, and complete information including your full legal name, date of birth, valid email address, mobile phone number, and residential address. Providing false, misleading, or fraudulent information is a material breach of these Terms and may result in immediate account termination.

Each User is permitted to maintain only one (1) account on gpera. Creating multiple accounts (commonly known as "multi-accounting") is strictly prohibited. gpera employs detection systems to identify duplicate accounts. Users found operating multiple accounts will have all accounts closed and funds forfeited.

4.2 Identity Verification

gpera is required under Philippine law and PAGCOR regulations to verify the identity of all account holders. You agree to provide government-issued identification (such as a passport, driver's license, or Philippine national ID) and proof of address upon request. Verification may be required before your first withdrawal or at any time thereafter.

Failure to complete identity verification within a reasonable timeframe may result in account restrictions, including but not limited to suspension of withdrawal privileges. gpera reserves the right to request additional documentation if initial verification is insufficient.

4.3 Account Security

You are solely responsible for maintaining the confidentiality of your account login credentials (username and password). You must not share your credentials with any third party. gpera will never ask you to disclose your password via email, phone, or any other communication method.

You agree to notify gpera immediately if you suspect any unauthorized access to or use of your account. gpera is not liable for losses resulting from unauthorized account access if you fail to maintain adequate security or notify us promptly of suspicious activity.

You may enable two-factor authentication (2FA) for enhanced account security. While optional, gpera strongly recommends activating this feature to protect against unauthorized access.

4.4 Account Responsibilities

You are responsible for all activity that occurs under your account, whether authorized by you or not. Any bets placed, deposits made, or communications sent from your account are deemed to have been made by you. You agree to monitor your account regularly and report any discrepancies or unauthorized transactions immediately.

5. Gaming Rules and Fair Play

5.1 Game Integrity

All games offered on gpera use certified random number generators (RNGs) or, in the case of live dealer games, physical equipment operated in licensed studios. Game outcomes are determined by chance and cannot be predicted or manipulated by gpera or any third party. gpera does not guarantee winnings and explicitly disclaims any liability for losses incurred through gameplay.

5.2 Betting Rules

All bets placed on gpera are final and cannot be cancelled once confirmed. It is your responsibility to review bet details before submission. gpera is not liable for errors in bet placement caused by User mistakes, device malfunctions, or connectivity issues.

Minimum and maximum bet limits vary by game and may be adjusted by gpera at any time. Current limits are displayed within each game interface. Bets exceeding maximum limits will be rejected. Bets below minimum limits will not be accepted.

5.3 Game Rules

Each game available on gpera is governed by its own specific rules, which are accessible within the game interface or via the game provider's information section. You agree to familiarize yourself with the rules of any game before placing bets. Disputes arising from misunderstanding of game rules will be resolved in accordance with the official rules as published.

5.4 Malfunctions and Errors

In the event of a game malfunction, system error, or technical failure, all affected bets and payouts are void. gpera will credit affected accounts with the original stake amount but is not obligated to honor erroneous payouts resulting from malfunctions. Players must report suspected malfunctions immediately via customer support.

5.5 Prohibited Activities

The following activities are strictly prohibited on gpera:

• Collusion with other players to gain an unfair advantage.
• Use of bots, automated software, or artificial intelligence tools to place bets or play games.
• Exploitation of software vulnerabilities, bugs, or glitches.
• Use of VPNs, proxies, or other tools to disguise location or identity.
• Reverse engineering, decompiling, or attempting to access gpera's source code or proprietary systems.
• Engaging in bonus abuse, including but not limited to creating multiple accounts to claim bonuses repeatedly.

Violation of these prohibitions will result in immediate account termination and forfeiture of all funds, including deposits and winnings. gpera reserves the right to pursue legal action against individuals engaged in fraudulent or criminal activity.

6. Deposits, Withdrawals, and Financial Terms

6.1 Deposits

gpera accepts deposits via GCash, Maya (PayMaya), bank transfer (BPI, BDO, Metrobank), and USDT. All deposits are processed in Philippine Pesos (PHP) unless otherwise specified for cryptocurrency transactions. Minimum deposit amounts vary by payment method and are displayed at the time of deposit.

Deposits are typically credited to your account instantly for e-wallet methods and within 1-3 business days for bank transfers. If a deposit does not appear in your account within the expected timeframe, contact customer support with transaction details.

gpera does not charge deposit fees. However, your payment provider (bank, e-wallet, or cryptocurrency network) may impose transaction fees, which are your responsibility.

6.2 Withdrawals

You may request a withdrawal at any time, provided your account is in good standing, identity verification is complete, and you have met any applicable wagering requirements associated with bonuses. Withdrawal requests are processed to the same method used for deposit unless that method does not support withdrawals, in which case an alternative method will be arranged.

Withdrawal processing times vary by method: GCash and Maya withdrawals are processed within minutes; bank transfers within 1-3 business days; USDT withdrawals are processed on-chain and subject to network confirmation times. gpera does not charge withdrawal fees, but your payment provider or network may impose fees.

gpera reserves the right to request additional verification documentation before processing withdrawals, particularly for large amounts or first-time withdrawals. This is a standard anti-money laundering (AML) and fraud prevention measure.

6.3 Anti-Money Laundering (AML) Policy

gpera complies with Philippine anti-money laundering laws and PAGCOR AML regulations. Suspicious transactions, including deposits followed by immediate withdrawal without gameplay, will be flagged and investigated. Accounts involved in suspected money laundering activity will be frozen and reported to relevant authorities.

You agree not to use gpera for money laundering, terrorist financing, or any other illegal financial activity. Violation of AML policies will result in account closure, forfeiture of funds, and potential legal consequences.

6.4 Dormant Accounts

Accounts with no login activity for twelve (12) consecutive months are considered dormant. gpera reserves the right to charge a monthly maintenance fee of PHP 500 (or equivalent) on dormant accounts until the balance reaches zero or the account is reactivated. Players will be notified via email before dormant account fees are applied.

7. Prohibited Conduct and Sanctions

7.1 General Prohibitions

In addition to the specific prohibitions outlined elsewhere in these Terms, the following conduct is strictly prohibited on gpera:

• Harassment, abusive language, or threatening behavior toward other players or gpera staff.
• Publication or distribution of defamatory, obscene, or illegal content via platform communication features.
• Impersonation of gpera staff, game providers, or other players.
• Spamming, phishing, or distribution of malware via platform messaging or communication channels.
• Circumventing account restrictions, bans, or self-exclusion measures.

7.2 Sanctions

Violation of these Terms may result in one or more of the following sanctions, at gpera's sole discretion:

• Warning or formal notice.
• Temporary suspension of account access.
• Forfeiture of bonuses, winnings, or deposits.
• Permanent account closure and ban from future use of gpera.
• Reporting to PAGCOR and relevant law enforcement authorities.
• Legal action to recover damages or pursue criminal charges.

gpera reserves the right to determine appropriate sanctions on a case-by-case basis. Decisions regarding sanctions are final and not subject to appeal unless required by law.

8. Limitation of Liability and Disclaimers

8.1 No Warranty

gpera provides the Services on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or free from viruses or other harmful components. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.2 Limitation of Liability

To the maximum extent permitted by Philippine law, gpera shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or related to your use of the Services, including but not limited to loss of profits, loss of data, or loss of goodwill, even if gpera has been advised of the possibility of such damages.

gpera's total liability to you for all claims arising out of or related to these Terms or the Services shall not exceed the amount of deposits you made to gpera during the three (3) months immediately preceding the event giving rise to liability.

8.3 Force Majeure

gpera shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, telecommunications failures, internet outages, government actions, or failure of third-party service providers.

8.4 Third-Party Content

gpera hosts games and content provided by third-party game developers. We do not control and are not responsible for the content, operation, or outcomes of third-party games. Disputes arising from third-party games should be directed to the respective game provider. gpera will assist in facilitating communication but is not liable for third-party conduct or decisions.

9. Account Termination and Closure

9.1 Termination by User

You may close your gpera account at any time by contacting customer support and requesting account closure. Upon closure, you must withdraw any remaining account balance. Failure to withdraw funds within thirty (30) days of closure may result in forfeiture of the balance to gpera.

9.2 Termination by gpera

gpera reserves the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Common reasons for termination include but are not limited to:

• Breach of these Terms.
• Failure to complete identity verification.
• Suspected fraudulent activity or money laundering.
• Violation of responsible gaming policies or self-exclusion measures.
• Abusive conduct toward gpera staff or other players.
• Technical or business reasons, such as discontinuation of services in certain jurisdictions.

Upon termination, your access to the Services will be revoked immediately. gpera will refund your account balance, less any amounts owed to gpera (including chargebacks, reversed transactions, or unpaid fees), to your verified payment method. Bonuses and promotional funds are forfeited upon termination.

9.3 Effect of Termination

Termination of your account does not relieve you of obligations incurred prior to termination. Sections of these Terms that by their nature should survive termination (including but not limited to liability disclaimers, indemnification obligations, and dispute resolution provisions) shall remain in effect.

10. Amendments to Terms

10.1 Right to Modify

gpera reserves the right to modify, amend, or update these Terms at any time, in our sole discretion, without prior notice. When changes are made, we will update the "Last Updated" date at the top of this document and, where material changes are involved, make reasonable efforts to notify affected Users via email or platform notification.

10.2 Acceptance of Changes

Your continued use of the Services following the posting of revised Terms constitutes your acceptance of those changes. If you do not agree to the modified Terms, you must cease using the Services and close your account.

10.3 Review Obligation

It is your responsibility to review these Terms periodically for updates. Failure to review updated Terms does not excuse non-compliance. You are deemed to have accepted any changes by continuing to use gpera after such changes are posted.

11. Intellectual Property

All content on the gpera platform, including but not limited to text, graphics, logos, images, software, and game interfaces, is the property of gpera or its licensors and is protected by Philippine and international intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from any content on gpera without express written permission.

The gpera name, logo, and all related marks are trademarks or registered trademarks of gpera. You may not use these marks without prior written consent.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of the Philippines.

12.2 Dispute Resolution Process

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services, you agree to first contact gpera customer support to attempt informal resolution. If the dispute cannot be resolved through customer support within thirty (30) days, either party may escalate the matter to PAGCOR for mediation or pursue legal action in Philippine courts.

12.3 Class Action Waiver

To the extent permitted by law, you agree to resolve any disputes with gpera on an individual basis and waive the right to participate in any class action, collective action, or representative proceeding.

13. Miscellaneous Provisions

13.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.

13.2 Entire Agreement

These Terms, together with our Privacy Policy and any additional rules or policies referenced herein, constitute the entire agreement between you and gpera regarding the Services and supersede all prior agreements, understandings, or communications, whether written or oral.

13.3 No Waiver

The failure of gpera to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver shall be effective unless made in writing and signed by an authorized representative of gpera.

13.4 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without gpera's prior written consent. gpera may assign or transfer these Terms, in whole or in part, without restriction and without notice to you.
